Welcome to Hugory! These Terms of Service ("Terms") govern your use of the website hugory.com and all related services provided by Hugory, Inc. ("Hugory," "we," "us," or "our"). By accessing or using our services, you agree to be bound by these Terms.

1. Overview of Services

Hugory provides a platform for purchasing and sending digital gift links. Our products are entirely digital — no physical goods are shipped or delivered. When you purchase a gift, you receive a unique link that can be shared with your intended recipient electronically.

2. Account and Eligibility

2.1 Age Requirement

You must be at least 13 years of age to use our services. If you are between 13 and 18, you must have the consent of a parent or legal guardian. By using our services, you represent that you meet these requirements.

2.2 Account Responsibility

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3. Digital Products and Licenses

3.1 Nature of Products

All products sold through Hugory are digital gift links. Upon purchase, you receive a limited, non-exclusive, non-transferable license to use the gift link for its intended purpose (sending a gift to a recipient).

3.2 Gift Templates

Hugory provides gift templates (designs, layouts, and graphics) for use with your gift links. You are granted a limited license to use these templates solely within the Hugory platform. You may not:

  • Reproduce, distribute, or sell the templates outside of the Hugory platform
  • Modify templates for use outside of the intended gifting purpose
  • Claim ownership of any Hugory-provided templates or designs

4. User-Generated Content

4.1 Your Content

You may upload or include personal messages, photos, and other content ("User Content") with your gift links. You retain ownership of your User Content, but you grant Hugory a non-exclusive, worldwide, royalty-free license to use, store, and display your User Content solely for the purpose of delivering your gift link to the intended recipient.

4.2 Content Guidelines

You agree not to upload or include content that:

  • Is illegal, threatening, defamatory, or obscene
  • Infringes any third-party intellectual property rights
  • Contains malware, viruses, or harmful code
  • Violates any applicable law or regulation

We reserve the right to remove any User Content that violates these guidelines without prior notice.

5. Payments

All payments are processed securely through Shopify Payments. By making a purchase, you agree to provide accurate and complete payment information. All prices are displayed in the applicable currency at the time of purchase. You agree to pay all charges incurred through your account at the prices in effect when the charges are incurred.

6. Refunds and Cancellations

Refunds and cancellations are governed by our Refund Policy. Please review that policy before making a purchase.

7. Intellectual Property

All content on the Hugory website, including but not limited to text, graphics, logos, icons, images, software, and designs, is the property of Hugory, Inc. or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws.

8. Prohibited Uses

You agree not to use our services to:

  • Violate any applicable law or regulation
  • Impersonate any person or entity
  • Interfere with or disrupt the service or servers
  • Attempt to gain unauthorized access to any part of the service
  • Use automated systems (bots, scrapers) to access the service without permission
  • Resell or commercially exploit the service without authorization

9. Limitation of Liability

To the fullest extent permitted by applicable law, Hugory, Inc. and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of our services.

Our total liability for any claim arising from or related to these Terms or our services shall not exceed the amount you paid to Hugory in the twelve (12) months preceding the event giving rise to the claim.

10. Disclaimer of Warranties

Our services are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Indemnification

You agree to indemnify, defend, and hold harmless Hugory, Inc. and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising out of or related to your use of our services or violation of these Terms.

12. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States of America, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or related to these Terms shall be brought exclusively in the state or federal courts located in Sheridan County, Wyoming.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website with a revised "Last Updated" date. Your continued use of our services after such changes constitutes acceptance of the new Terms.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
